Le monde libre n’accepte pas que le détenu palestinien paralysé Ayaman Kurd reste torturé sans solutions afin de finir sa souffrance

La Commission des Affaires des Détenus et Ex-Détenus a appelé les organisations de défense de droits humains à travers le monde entier, de traiter la question de détenu palestinien Ayaman Kurd qui souffre de d'un état de santé tragique dans les geôles de l'occupation israélienne.

La commission a déclaré que le jeune détenu de Jérusalem Kurd a fini sa sixième année de détention dans les geôles de l'occupation, notant qu’il a été condamné à 35 ans de prison, en plus d'une amende de 330 000 shekels.

Elle a également indiqué que le détenu Kurd souffre d'un problème dans le système nerveux et digestif et d'une hémiparalysie des membres inférieurs, après avoir été abattu par l'armée d'occupation israélienne, c'est pourquoi il se déplace en fauteuil roulant, il vit dans des conditions difficiles à la clinique de la prison de « Ramla », remarquant qu'il souffre des douleurs constantes, et l'administration des geôles israéliennes lui donne des antidouleurs sans lui traiter et faire un bon diagnostic de son état. 

Le jeune Kurd a été arrêté le 19 septembre 2016 au quartier Bab Al-Sahira de Jérusalem, sous prétexte qu’il a mené une attaque à l'arme blanche, où deux soldats israéliens ont été blessés, et même le détenu Al-Kurd  a été grièvement blessé, après avoir abattu par 13 balles à bout portant, et il a  saigné pendant une heure sans soin médicale. 

Il convient de mentionner que le jeune Kurd a 25 ans, et il est un des victimes de négligence médicale dans les prisons israélien, et récemment il a rejoint la liste longue de détenus patients à la clinique de la prison de « Ramla », malgré sa souffrance et ses conditions difficiles, les autorités d’occupation israélienne continuent d’ignorer son état tragique. 

Abu Baker calls on the Palestinian Bar Association to focus on the legal treatment of detainees in case of escape from prison

The head of the Commission of Detainees' Affairs, Qadri Abu Baker, called on the Palestinian Bar Association and the institutions of this field to shed light upon the international legal status of the four detainees who escaped from Gilboa prison, and have been rearrested in the occupied territories.

Abu Baker confirmed that the international agreements, treaties and covenants have discussed this issue, and that there are many articles and texts stipulated the legal treatment of detainees in such case. These articles prevents taking revenge of them, where article (28) Brussels Declaration of 1874, named "draft of the International Declaration on the Laws and Customs of War", stipulated that "weapons should be used against any war prisoner that try to escape, and if he has been rearrested during trying to escape he shall be only subjected to disciplinary punishment or more stringent monitoring, but if he succeeds in escaping and is caught later, he should not be punished.”

In 1907, the special agreement on respecting the laws of field war by Hague Convention, which had a worldwide consensus, and today it is a part of customary international law. Article (8) of the same convention stipulated that "the clause in Brussels Declaration which talks about using a weapon against a prisoner who tries to escape has been deleted. The convention also confirmed that "any prisoner who tries to escape and got caught before escaping should be subjected to disciplinary punishment, while if he succeeded escaping and got rearrested, he should not be punished for the act of escaping".

Moreover, Geneva Convention of 1929 reaffirmed in article (50) on the same text, which was also mentioned in Hague Convention, and amended article 91-94 from the Third Geneva Convention of 1949, which has been approved and ratified by more than 190 states, including Israel and the United States of America.

Abu Baker recalls on all Palestinians of official and local institutions to work hard to support our detainees, and practice pressure against international organizations to protect our detainees by applying the international agreements, being prisoners of liberation movements.

It is worthy to mention that the escaped detainees who got rearrested are: Zakaria Zbaidy, Muhammad Arda, Mahmoud Arda, Yaqub Qadri.

The occupation court postpones the Judgment in the request of releasing the pregnant detainee Aldeek on bail next Sunday

The lawyer of the Commission of Detainees Akram Samara stated yesterday, that military court of Ofar postponed the judgment in releasing the pregnant detainee Anhar Aldeek with a bail, until next Sunday 5/9/2021.

The commission said that the lawyer Samara submitted a request to release the detainee Aldeek who is suffering   from difficult detention conditions in her last weeks of pregnancy with her fetus (Alaa).

It is worthy to mention that the 26-year- old detainee Anhar Aldeek from Kofor Na’ma /Ramalla, was arrested on 8/3/2021 which marks international women’s day, while was pregnant in her 3rd month.  She was detained and held in bad conditions without taking into consideration her health conditions. Anhar's case will be the ninth women that gives birth in prison if she wasn’t released noting that she could be in labor any moment.

The Commission of Detainees' Affairs called on the human rights organizations not to stay silent towards the suffering of the detainee Ayman Kurd, who suffers from tragic health condition in Israeli prisons.

The commission stated that Aymad Kurd is in his sixth year in prison, and that he's sentenced to 35 years and a fine of 330.000 NIS.

He suffers from a defect in the nervous and digestive systems and hemiplegia in his lower limbs. He moves using a wheelchair and lives in bad health conditions at the clinic of Ramla prison. The prison Service gives him painkillers only, without making a proper medical diagnose.

 Kurd has been detained in 19/9/2016, and sentenced to 35 years of imprisonment, under the charge of a stabbing attack, where he injured two soldiers in Jerusalem. He got injured with 13 bullets from a close distance and kept for more than one hour without any medical aid.

The commission stated that the detainee Ayma Kurd is one of the victims of the deliberate medical ignorance practiced by the prisons' administration. He is currently held at the clinic of Al-Ramla prison, joining a long list of sick detainees. 

The Captive movement will start an escalating program in all prisons next Friday

The Commission confirmed that the captive movement in Israeli prisons with all its political factions will start a real escalating program next Friday, protesting against the continuous attacks against the detainees in the last couple of days, which came as a result of the escaping of 6 detainees from Gilboa prison. The occupation authorities were able to catch 4 of them.

The commission stated that the captive movement agreed on challenging the prison administration, and won’t accept the attack against them, which is conducted to cover the Israeli   security failure in Gilboa prison.

Moreover, he commission added that the escalating program will take place on Friday, where they will not deal with the prison service, and will rebel against their laws, where some of the captive movement leaders will go on an open hunger strike.

The commission also stated that the situation inside prison is concerning, and the    assaults and attacks against detainees is unbearable.

The detainee Salem Zaidat ends his hunger strike after an agreement to end his administrative detention.

The commission of Detainees' Affairs stated that the detainee Salem Zedat (40) years, from Hebron/ Bani Nai'm ,has ended his hunger strike after coming to an agreement with the prison service  to end his arbitrary administrative detention, where the current sentence should be genuine and to be released on 15/11/2021.

 

The commission pointed out that the detainee Zaidat went on hunger strike for (43) days protesting against his administrative detention, where he is currently held at Al-Ramla clinic suffers from deteriorating health condition as he lost more than (16) kg, and has severe pain all over his body, continuous dizziness and heart problems.  

It was mentioned that the detainee Zaidat is a former detainee who spent two years in prison, and has been rearrested in February 2020. He was sentenced to (4) months of imprisonment and after he finished his term the  occupation authorities refused to set him free ,where the Israeli intelligence service sentenced  him  to   administrative detention.  His sentence was renewed 4 times, which forced him to go on a hunger strike since 43 days. The occupation authorities refused the plea two times, which was submitted by the lawyer of the commission against his administrative detention.

The commission pointed out that there are 8 detainees on hunger strike, protesting against their administrative detention, including two detainees who are striking since more than 40 days.

 

 

Le général Abu-Baker appelle les avocats palestiniens et le syndicat juridique à aborder le sujet du traitement juridique des détenus en cas de leur libération (évasion) de la prison

Le chef de la Commission des Affaires des Détenus et Ex-détenus, Le général Qadri Abu- Bakr, a appelé le Syndicat des avocats et juristes palestiniens, ainsi que les institutions travaillant dans ce domaine, à aborder le sujet du traitement juridique des quatre détenus palestiniens qui ont réussi à s'échapper de la geôle d’occupation de « Gilboa », et ont été de nouveau arrêtés par l'occupation israélienne hier et avant-hier dans les territoires de 1948.
Abu Baker a confirmé que les accords, traités et pactes internationaux ont abordé cette question et qu'il existe de nombreux articles et textes stipulant le traitement juridique des détenus dans de tels cas, et ces articles empêchent de se venger d'eux.
Par exemple, l'article (28) de la Déclaration de Bruxelles de 1874, qui est nommé «Projet d'une Déclaration internationale concernant les lois et coutumes de la guerre. », stipulait que «Les prisonniers de guerre sont soumis aux lois et règlements en vigueur dans l'armée au pouvoir de laquelle ils se trouvent », « Contre un prisonnier de guerre en fuite il est permis, après sommation, de faire usage des armes. Repris, il est passible de peines disciplinaires ou soumis à une surveillance plus sévère. Si, après avoir réussi à s'échapper, il est de nouveau fait prisonnier, il n'est passible d'aucune peine pour sa fuite antérieure ».
En plus, en 1907 la Convention concernant les lois et coutumes de la guerre sur terre « La convection de La Haye », a adopté la même clause, notant que d’ans l’article 8 stipulait que « Les prisonniers de guerre seront soumis aux lois, règlements et ordres en vigueur dans l'armée de l'Etat au pouvoir duquel ils se trouvent. Tout acte d'insubordination autorise, à leur égard, les mesures de rigueur nécessaires.
Les prisonniers évadés, qui seraient repris avant d'avoir pu rejoindre leur armée ou avant de quitter le territoire occupé par l'armée qui les aura capturés, sont passibles de peines disciplinaires.
Les prisonniers qui, après avoir réussi à s'évader, sont de nouveau faits prisonniers, ne sont passibles d'aucune peine pour la fuite antérieure ».
Par ailleurs, l'article 50 dans la Convention de Genève de 1929, a réaffirmé le même texte, qui figurait dans la Convention de La Haye, également les articles 91-94 de la Troisième Convention de Genève de 1949, qui ont été approuvé par plus de 190 pays, entre eux (Israël) et (les États-Unis).
Le général Abu-Bakr a appelé de nouveau le peuple palestinien, ses institutions officielles et civiles, de soutenir nos prisonniers nos détenues par tous les moyens possibles, et d’essayer autant que possible, d’obliger les organismes internationaux, d’assurer la protection pour nos détenus palestiniens par l'application des accords internationaux, parce qu’ils sont prisonniers des mouvements de libération, et d'empêcher l'occupation israélienne de se venger d’eux.
Il convient de noter que les quatre détenus palestiniens qui ont réussi à s'échapper de la geôle de « Gilboa », et ont été de nouveau arrêtés par l'occupation israélienne hier et avant-hier dans les territoires de 1948, sont (Mahmoud Al-Ardah, Yacoub Al-Qadri, Muhammad al-Ardah et Zakaria al-Zubeidi) alors que les deux prisonniers Ayham Kamamji et Monadel Naifat sont toujours libres.

The Commission of Detainees' Affairs calls on the media and openly the international community and its Institutions, foremost International committee of the Red Cross to act immediately to end the Nazi acts of the Israeli prison service and special units in Naqab prison.

The commission stated that section 6 is under a cruel attack, where it was attacked by domesticated special units with different weapons and trained dogs, supported by a number of Israeli military soldiers that were summoned urgently from a nearby Military base, with ambulances accompany them. Detainees have been handcuffed, get thrown out and beaten. In response, the detainees burned down 7 room cells.

The commission warned of the shameful international silence, and stated that the continuous escalation means real war inside the prison, violating detainees' lives will   lead to a real confrontation with the same level inside and outside the prison. We refuse to turn our detainees into victims to cover up the occupation government and its military services defeat against 6 heroic detainees, who broke a strong   security system that was praised by the Israeli prison service.

The commission pointed out that the incursions and penalties included most of the detainees in all prisons, as it is heading towards more racial and retaliatory acts under directions from Israeli political Military support.

Therefore, the National and Islamic Factions and Institutions working in the field of detainees and all people have to support our detainees and to prevent Israel from taking revenge of them.

The Commission of Detainees' Affairs denounces the barbaric attack against detainees at Jelboa prison, and a state of tension prevails

The Commission of Detainees' Affairs expressed its deep concern of the brutal and racist attack against detainees in all prisons, especially after the sudden storming of Jelboa prison yesterday.

The commission reported that Al-Yamaz and Drour Special Forces broke into section (1) and (4) of Jelboa prison and conducted many attacks and inspections inside the section, knowing that those section include detainees from Fatah Movement.

The Commission stated the storming have been implemented without any justification, and that the Special Forces intended to revoke detainees and destroy their belongings, where the state of tension still prevailing among detainees in all sections of the prison.
