The Commission of Detainees' Affairs and the Palestinian Society Prisoner's Club addressed International Organizations with an urgent appeal to reveal the fate of Gazan detainees and stop the crime of "forcible hide" committed against them

 Ramallah
December 18, 2023

The Commission of Detainees' Affairs and the Palestinian Society Prisoner's Cluc made an urgent appeal to human rights organizations to practice pressure against Israel to reveal the fate of detainees from Gaza Strip and stop the forcible hide practiced against them.

This came in the context of receiving information on terrible crimes committed against Gazan detainees, the last of which was published by Haaretz newspaper, reported the martyrdom of many detainees from Gaza at "Sadeh timan" military camp in Beersheba after the 7th of October, without revealing the accurate number or martyrdom conditions.

The Commission and the Prisoner's Club stated that the Israeli authorities, after 73 days of the aggression and genocide in Gaza, continue to hide information about Gazan detainees, which constitutes a flagrant violation the international law, as we warned many times of pursuing this policy in order to commit executions against them.

The Commission and the Prisoner's Club stated in a joint report that the occupation's insistence on hiding the fate of Gazan detainees conveys one explanation, that there is a decision to take revenge of them in order to commit more crimes against them in secret. However, the Israeli forces published terrible pictures and videos on detention operations against hundreds of people from Gaza while being undressed during the ground invasion, and holding them in degrading conditions, which constitute the gravest crimes committed against them.

Despite all the requests submitted by the Commission pf Detainees' Affairs and the Palestinian Society Prisoner's Club to the ICRC and international human rights organizations to force Israel to reveal the fate of Gazan detainees, all requests have been refused, and the Israeli authorities did not reveal the identity of the detainee who died in (Anatot military camp).

The information we have on them is represented in detaining women from Gaza at Damoun prison, including elderly and baby girls, and holding men form Gaza at ( Jalamah, Betah Tikva, Ashkelon, Ofer), in addition to military camps such as: ( Antot and Sadeh Timan), in addition to the announcement of Ben Gvir that he had submitted a request to the IPS to transfer Gazan detainees to Rakvit section, located underneath Ramla-Nitsan prison.

Moreover, the IPS announced that (260) detainees from Gaza are held and classified as illegal fighters after the 7th of October. We received many testimonies from liberated detainees, especially from Ofer prison, stating that detainees from Gaza are subjected to awful crimes.

The Israeli government tends to amend the law of illegal fighters since the beginning of the war in Gaza, the last of which is allowing to detain captives for 42 days before issuing the order of detention, and the judicial review of the order to be done after 45 days of signing the order, and preventing the detainee from meeting his lawyer for 80 days. The forcible hide of detainees constitutes a flagrant violation of the international law.

The Israeli government also amended the law of detention 1996, which applies on Gazan detainees who are subjected to interrogation in different centers, where the sentence of detainee is extended to 45 of interrogation and he is prevented from meeting his lawyer for 80 days, without any supervision by the court on the detention conditions or being subject to torture. There is no accurate number for detainees who are being interrogated.

We recall the ICRC, the United Nations and human rights organizations to do their role in the light of the increasing crimes committed by the occupation against our detainees, especially detainees from Gaza Strip.

Women detainees from Gaza are subjected to retaliatory penalties

 December 17, 2023

The Commission of Detainees’ Affairs stated in a report issued today that women detainees at Damoun prison, especially Gazans, are facing very difficult detention conditions and subjected to strict punishments since the beginning of the war.

The commission said that the Israeli forces mounted a massive campaign of arrests in the West Bank, Jerusalem and Gaza Strip against women, whom all of them were subjected to torture and assault, beating, cursing, naked inspection , isolation and deprivation of rights.

The IPS tended to treat detainees from Gaza with the most degrading manner, as a detainee stated “80-year- old woman from Gaza arrived to the section, walking with crutches, not wearing a hijab, it seems like she suffers from Alzeimers.

They took the clothes of women detainees from Gaza , exchanging them with summer outfits, where they suffered from difficult times before arriving at Damoun prison, as they have been subjected to intense beat, humiliation and attacks. Some of them remained 7 days outside the prison in the cold weather. A Gazan detainee said that she was accompanied with her four children during arrest, and she gave them to a stranger man and left without knowing anything about them”.

The IPS intended to isolate women detainees from Gaza, so they can commit crimes against them without being held accountable.

The Israeli occupation breaches exchange deals by chasing the liberated detainee Fadwa Hamadah

 December 11, 2023

The Commission of Detainees’ Affairs warned of breaching the conditions of the exchange deal by chasing the detainee Fadwa Hamadah from Jerusalem.

The Commission stated that the Israeli authorities held a trial in absentia to the detainee Hamadah in the Magistrate Court of Haifa, where the judge decided to hold a session in her presence, accompanied by her lawyer.

The Commission confirmed that Hamadah’s summon came under the claim that she committed breaches during her detention against the IPS and its officers, and that she has to be held accountable, without taking into consideration that she was liberated by an exchange deal.

The commission emphasized that what happened in the magistrate court of the occupation poses a legal dilemma to the detainee Hamadah and all liberated detainees by the deal, where this revealed that their cases are still opened in the Israeli courts.

The Commission called on the Palestinian Resistance and the mediators who supervise the exchange deal, especially Egypt and Qatar , to take serious action to this incident and compel Israel to adhere to the conditions of the deal and never chase liberated persons.

It is worth mentioning that the detainee Fadwa Hamadah, 35, from Sour Baher/ Jerusalem, has been arrested in 2017 and sentenced to 10 years of imprisonment, in addition to a fine of 30.000 ILS, where she was liberated in the last exchange deal between Israel and the Palestinian Resistance.
